La présente politique de confidentialité a pour but d'exposer aux utilisateurs de l'application mobile :

Doivent être considérées comme données personnelles toutes les données étant susceptibles d'identifier un utilisateur. Il s'agit notamment du prénom et du nom, de l'âge, de l'adresse postale, le courriel, la localisation de l'utilisateur ou encore son adresse IP ;
  • Quels sont les droits des utilisateurs concernant ces données ;
  • Qui est responsable du traitement des données à caractère personnel collectées et traitées ;
  • A qui ces données sont transmises.

ARTICLE 2 : PRINCIPES GÉNÉRAUX EN MATIÈRE DE COLLECTE ET DE TRAITEMENT DE DONNÉES

Conformément aux dispositions de l'article 5 du Règlement européen 2016/679, la collecte et le traitement des données des utilisateurs de l'application mobile respectent les principes suivants :

  • Licéité, loyauté et transparence : les données ne peuvent être collectées et traitées qu'avec le consentement de l'utilisateur propriétaire des données. A chaque fois que des données à caractère personnel seront collectées, il sera indiqué à l'utilisateur que ses données sont collectées, et pour quelles raisons ses données sont collectées ;
  • Finalités limitées : la collecte et le traitement des données sont exécutés pour répondre à un ou plusieurs objectifs déterminés dans les présentes conditions générales d'utilisation ;
  • Minimisation de la collecte et du traitement des données : seules les données nécessaires à la bonne exécution des objectifs poursuivis par l'application mobile sont collectées ;
  • Conservation des données réduites dans le temps : les données sont conservées pour une durée limitée, dont l'utilisateur est informé. Lorsque cette information ne peut pas être communiquée, l'utilisateur est informé des critères utilisés pour déterminer la durée de conservation ;
  • Intégrité et confidentialité des données collectées et traitées : le responsable du traitement des données s'engage à garantir l'intégrité et la confidentialité des données collectées.

Afin d'être licites, et ce conformément aux exigences de l'article 6 du règlement européen 2016/679, la collecte et le traitement des données à caractère personnel ne pourront intervenir que s'ils respectent au moins l'une des conditions ci-après énumérées :

  • Le traitement est nécessaire à la bonne exécution d'un contrat ;

    Données utilisées pour la création de comptes utilisateur et de réservations de courses de taxi dans le Système d'Information de l'application mobile.

  • Informations récupérées automatiquement :
    • système d'exploitation (nature et version),

    • localisation : permet de connaître la position de l'utilisateur (seulement lorsque l'application est utilisée en premier plan),
    • téléphone : permet de passer des appels au groupement de taxis,
    • accès au stockage du terminal : consultation des reçus,
    • contacts :
      • affichage des contacts avec l'adresse directement depuis l'application mobile,
      • adresses de courrier électronique pour le préremplisssage du formulaire d'inscription au service,
      • calendrier : ajout des réservations effectuées au calendrier.
  • Analyse :
    • Firebase Crashlytics et Google Play Services : collecte de données anonymes (analyse crashs et requêtes).

Ces données sont collectées lorsque l'utilisateur effectue l'une des opérations suivantes sur l'application mobile :

  • Lorsque l'utilisateur s'inscrit sur l'application mobile.
  • Lorsque l'utilisateur fait une demande de réservation de course.
  • Lorsque l'utilisateur déclare un moyen de paiement.
  • Lors des dysfonctionnement de l'application.

Par ailleurs, lors d'un paiement sur l'application mobile, il sera conservé dans les systèmes informatiques de l'éditeur de l'application mobile une preuve de la transaction comprenant le bon de commande et la facture.

Le responsable du traitement conservera dans ses systèmes informatiques de l'application mobile et dans des conditions raisonnables de sécurité l'ensemble des données collectées pour une durée de :

  • Les données personnelles concernant le compte client : aussi longtemps que dure l'inscription sur l'application Taxis Radio Aixois.
  • Les données transmises lors d'une demande (commande de course, contact, devis, support) sont conservées au maximum 24 mois.

La collecte et le traitement des données répondent aux finalités suivantes :

  • commandes de réservations de courses.

Les traitements de données effectués sont fondés sur les bases légales suivantes :

  • consentement de l'utilisateur.

A. LE RESPONSABLE DU TRAITEMENT DES DONNÉES

Le responsable du traitement des données est chargé de déterminer les finalités et les moyens mis au service du traitement des données à caractère personnel.

B. OBLIGATIONS DU RESPONSABLE DU TRAITEMENT DES DONNÉES

Le responsable du traitement s'engage à protéger les données à caractère personnel collectées, à ne pas les transmettre à des tiers sans que l'utilisateur n'en ait été informé et à respecter les finalités pour lesquelles ces données ont été collectées.
Les services Web disposent d'un certificat SSL afin de garantir que les informations et le transfert des données transitant par l'application mobile sont sécurisés.
Un certificat SSL ("Secure Socket Layer" Certificate) a pour but de sécuriser les données échangées entre l'utilisateur et les services Web.
De plus, le responsable du traitement des données s'engage à notifier l'utilisateur en cas de rectification ou de suppression des données, à moins que cela n'entraîne pour lui des formalités, coûts et démarches disproportionnés.
Dans le cas où l'intégrité, la confidentialité ou la sécurité des données à caractère personnel de l'utilisateur est compromise, le responsable du traitement s'engage à informer l'utilisateur par tout moyen.

ARTICLE 5 : DROITS DE L'UTILISATEUR

Conformément à la réglementation concernant le traitement des données à caractère personnel, l'utilisateur possède les droits ci-après énumérés.

c. Droit à la limitation et à l'opposition du traitement des données

L'utilisateur a le droit de demander la limitation ou de s'opposer au traitement de ses données par le service, sans que le servcie ne puisse refuser, sauf à démontrer l'existence de motifs légitimes et impérieux, pouvant prévaloir sur les intérêts et les droits et libertés de l'utilisateur.

d. Droit de ne pas faire l'objet d'une décision fondée exclusivement sur un procédé automatisé

Conformément aux dispositions du règlement 2016/679, l'utilisateur a le droit de ne pas faire l'objet d'une décision fondée exclusivement sur un procédé automatisé si la décision produit des effets juridiques le concernant, ou l'affecte de manière significative de façon similaire.

e. Droit de déterminer le sort des données après la mort

Il est rappelé à l'utilisateur qu'il peut organiser quel doit être le devenir de ses données collectées et traitées s'il décède, conformément à la loi n°2016-1321 du 7 octobre 2016.

f. Droit de saisir l'autorité de contrôle compétente

Dans le cas où le responsable du traitement des données décide de ne pas répondre à la demande de l'utilisateur, et que l'utilisateur souhaite contester cette décision, ou, s'il pense qu'il est porté atteinte à l'un des droits énumérés ci-dessus, il est en droit de saisir la CNIL (Commission Nationale de l'Informatique et des Libertés, https://www.cnil.fr) ou tout juge compétent.

B. DONNÉES PERSONNELLES DES PERSONNES MINEURES

Conformément aux dispositions de l'article 8 du règlement européen 2016/679 et à la loi Informatique et Libertés, seuls les mineurs âgés de 16 ans ou plus peuvent consentir au traitement de leurs données personnelles.
Si l'utilisateur est un mineur de moins de 16 ans, l'accord d'un représentant légal sera requis afin que des données à caractère personnel puissent être collectées et traitées.
L'éditeur de l'application mobile se réserve le droit de vérifier par tout moyen que l'utilisateur est âgé de plus de 16 ans, ou qu'il aura obtenu l'accord d'un représentant légal avant d'utiliser l'application mobile.

The Owner Taxis Radio Aixois takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.
The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Application (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. A SSL Certificate ("Secure Socket Layer" Certificate) is aimed to secure Data exchanges between the Users and the Mobile Application Information System.

The Owner may process Personal Data relating to Users if one of the following applies:

Users are also entitled to learn about the legal basis of Data transfers to a country outside the European Union or to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by the Owner to safeguard their Data.

Retention time

Personal Data shall be processed and stored for as long as required by the purpose they have been collected for.

Therefore:

  • Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
  • Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.
  • Personal Data regarding the User's account are retained as long as the sign-up last on the Mobile Application Taxis Radio Aixois.
  • Personal Data collected during a request (booking, contact, quote, support) are retained for a maximum of 24 months.

The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right of access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

Unless specified otherwise, all Data requested by this Application is mandatory and failure to provide this Data may make it impossible for this Application to provide its services. In cases where this Application specifically states that some Data is not mandatory, Users are free not to communicate this Data without consequences to the availability or the functioning of the Service.

Users are responsible for any third-party Personal Data obtained, published or shared through this Application and confirm that they have the third party's consent to provide the Data to the Owner.

    Depending on the User's specific device, this Application may request certain permissions that allow it to access the User's device Data as described below.

    By default, these permissions must be granted by the User before the respective information can be accessed. Once the permission has been given, it can be revoked by the User at any time. In order to revoke these permissions, Users may refer to the device settings or contact the Owner for support at the contact details provided in the present document.
    The exact procedure for controlling app permissions may be dependent on the User's device and software.

    Please note that the revoking of such permissions might impact the proper functioning of this Application.

    If User grants any of the permissions listed below, the respective Personal Data may be processed (i.e accessed to, modified or removed) by this Application.

    • precise location: used to know the user's location (only when the Mobile Application Taxis Radio Aixois is running in foreground),
    • telephone number: used to make phone calls to the taxi company,
    • device data storage: used to read receipts,

      • e-mail used to pre-fill sign-up form,
    • calendar : used to add bookings to calendar.

    • Firebase Crashlytics and Google Play Services: Anonymous Usage Data for crash analysis and requests.

These Personal Data are collected when one of the following event occurs :

  • when the user signs-up on the Mobile Application Taxis Radio Aixois,
  • when the user books a taxi,
  • when the user records a credit card,
  • on a Mobile Application malfunction.

In addition, during an In-app Payment a proof of the transaction will be collected by Mobile Application Taxis Radio Aixois Information Systems including the order form and the invoice.

The collection and processing of data meet the following purposes :

  • Taxi ride booking orders.

B. PERSONAL DATA SHARED WITH THIRD PARTY SERVICES

C. DATA PROCESSING AND STORAGE

Personal Data is collected for the following purposes and using the following services:

  • Services provided directly by the Mobile Application Taxis Radio Aixois
    • Registration and authentication
      By registering or authenticating, Users allow this Application to identify them and give them access to dedicated services. The Personal Data is collected and stored for registration or identification purposes only. The Data collected are only those necessary for the provision of the service requested by the Users.
      The User registers by filling out the registration form and providing the Personal Data directly to this Application.
    • Taxi ride booking orders
      By booking a taxi ride, Users allow this Application to collect data related to the ride they order. The Personal Data is collected and stored for booking purposes only. The Data collected are only those necessary for the provision of the service requested by the Users.
      The User books a taxi ride by filling out the booking form and providing the Personal Data directly to this Application.

      These Personal Data are collected and processes exclusively in France by the Host (Tessa).

  • Registration and authentication by third party services
    By registering or authenticating, Users allow this Application to identify them and give them access to dedicated services. Depending on what is described below, third parties may provide registration and authentication services. In this case, this Application will be able to access some Data, stored by these third-party services, for registration or identification purposes. Some of the services listed below may also collect Personal Data for targeting and profiling purposes; to find out more, please refer to the description of each service.
    • Google OAuth
      Google OAuth is a registration and authentication service provided by Google LLC or by Google Ireland Limited, depending on the location this Application is accessed from, and is connected to the Google network.

    This type of service allows this Application to access Data from your account on a third-party service and perform actions with it. These services are not activated automatically, but require explicit authorization by the User.

Users may exercise certain rights regarding their Data processed by the Owner.
